Rules imposed by the employer

The disciplinary rules that might be imposed by the employer shall be:

2 – Fine or penalty

3 – Delay with reduced pay for a defined period but it should not more than ten days

6 – Release from work without injustice to the end of service benefit

Issuance of a model list by Minister of Labor and Social affairs

The Minister of Labor and Social Affairs shall issue, a model list of disciplinary rules and rewards by means of a division thereof, in order to direct the employers in setting their own rules in this regard.

Penalty

The penalty might be a particular amount or an amount equal to the salary of the worker for a particular period. The fine approved with regards to one violation may not exceed the salary of five days.

Employee’s record concerning fines

Fines imposed on employees shall be recorded in a particular register together with the reason and circumstances of obligation. The name and salary of the employee will also be mentioned in this register and in this regard, decisions will be issued by the Minister of Labor and Social Affairs.

Rejection of penalty

The penalty of denial of the periodic grant might only be forced once per year. Such grant or allowance may not be delayed for more than six months.

The penalty of lack of the promotion might not be imposed for more than one promotional cycle.

Financial Differences

No disciplinary permit might be imposed on the employee for an act committed thereby outside the office, unless such action is related to the work, the company or the responsible manager.

It shall not be acceptable to impose on the worker any of the permits, after having heard the worker and the defense investigated, and after having recorded the matter in minutes put down in his personal file.

Disciplinary offense

The employee might not be charged with a disciplinary offense after thirty days of the discovery.

Temporarily suspension

The employee might be temporarily suspended from job upon the charging thereof of a planned crime against life, property, reputation, sincerity or of carrying out a strike.
